2016 HELP: If you use textures that are licensed for non-commercial use, can you let them be photographed?

If textures are licensed for non-commercial use,
can they appear in pictures?  Probably not.
You need to be careful when using textures that are restricted to non-commercial use. If you use it in a build, it may be used in photographs in ways that violate the restriction.

If you build in a virtual world and make your build open to the public, you may expect your build to be photographed.  You may be building for non-commercial use, so you may think it is ok to use textures licensed for non-commercial use.  But you may need to think that through more carefully

If the textures are photographed, you lose control of how they are used.  They are likely to be posted on the internet, which means that the photographer also loses control of use.  The photographer must give the hosting site license to display the photograph or it doesn't  go on the web.  The hosting site is probably operating as a commercial business.  The picture is displayed to draw people to the site, so the picture is being used for commercial purposes.
        -
You are generally obliged to convey any license restrictions on the use of an image along with the presentation of an image, except, perhaps, where there is no possibility of copying the image.
        -
In such cases, it is not clear whether the texture you have used in your build is being used commercially.  Probably not if it just appears incidentally and incompletely in the image.  But if the texture appears prominently in the image and especially if the texture is part of the focus of attention in the image, the use could be commercial.
        -
No matter that you did not do it--you were obliged to include the license limitation if you used it in a way that let it be copied.  You could give the license limitation on a sign next to the texture.  And that might be the thing to do in the case of some texture of great importance to the build.  But if the texture is not critical, you would probably just avoid using it.
